The order came on the complaint of Southwest India Machine Trading which alleged that the company imposed unfair and restrictive conditions in supplying backhoe loader and soil compactor.
As per the complainant, the restrictive terms were completely against any agreement between the parties.
For the case, Competition Commission of India (CCI) considered two relevant markets -- one that for 'manufacture and sale of backhoe loaders in India' while another for 'manufacture and sale of vibratory soil compactors in India.'
Rejecting the allegations, CCI said the 'opposite party (Case New Holland) does not enjoy dominant position either in the market for manufacture and sale of backhoe loaders in India or in the market for manufacture and sale of vibratory soil compactors in India.
