It was alleged that the two companies abused their market position apart from imposing unfair terms and conditions in the letter of allotment with respect to a flat in 'Kalpataru Harmony' at Wakad area in Pune.
Rejecting the complaint, the regulator said there is no evidence of abuse of dominant position that violates Section 4 of the Competition Act.
Competition Commission of India (CCI) observed that the facts and allegations of the present matter are similar to case where it had passed a ruling in January this year. The earlier complaint, which was also against the same companies and same project, was rejected after finding no evidence of abuse of dominance.
Stating that the present matter is similar to the earlier case, the Commission said it is of the view that no contravention of Section 4 is made out against Aura Real Estate and Waghere Promoters.
Section 4 of the Competition Act pertains to abuse of dominant market position.
