It was alleged that the two Pune-based companies abused their market position by not delivering the possession of a flat in 'Kalpataru Harmony' at Wakad area in Pune in a timely manner and also imposed unfair terms and conditions through letter of allotment.
It was also alleged that the companies did not address concerns of the complainant relating to the flat.
For this case, 'the provision of services for development and sale of residential apartments/ flats in Pune' was considered as the relevant market by the regulator.
"In the absence of dominance of any of the OPs in the relevant market, the assessment of their alleged abusive conduct does not arise. Accordingly, the Commission finds that no case of contravention of the provisions of section 4 of the Act against OPs," the commission said.
Section 4 of the Competition Act pertains to abuse of dominant market position.
