CCI rejects unfair business charges against MVL Ltd

Fair trade regulator CCI has rejected a complaint alleging that real estate firm MVL Ltd abused its dominant market position with respect to services of development and sale of commercial IT space in Gurgaon.
A complaint by an individual had alleged MVL of imposing unfair and anti-competitive terms and conditions in the buyers agreement.
In an order released today, the Competition Commission of India (CCI) said that "no prima facie case of contravention of the provisions of...The (Competition) Act is made out against the opposite party".
The Commission observed that MVL "does not appear to be in a dominant position since many other large real estate developers....Are operating in the relevant market".
"These large developers are competing with each other in the relevant market with projects of varying magnitudes and having bigger or similar size and resources compared to the opposite party," the regulator said.
"Presence of such players with comparable projects in the relevant market indicates that the buyers have the option to choose from the various developers in the relevant geographic market (Gurgaon)," it added.
The case relates to IT/ Cyber Complex developed by MVL in Sector 35, Gurgaon, Haryana.
