Justice Siddharth Mridul issued notice to the government and Delhi Police seeking their replies to the plea of the victim's father who has alleged that the police "manufactured the complaint" by asking him to sign blank papers when he was in the hospital.
The petitioner, Shyam Sunder Kausal, has alleged that the police "maliciously" mentioned in the complaint that he was present at the site with his family when the incident had occurred, whereas in reality he was at his tea-stall.
The petition, filed through advocate Akash Vajpai, has contended that the "substance of the present FIR will vitiate the trial and the investigation."
The petitioner also said if the police during the probe finds that Vikrant was responsible for the firing they can move against him but to make him a "target" by means of the "manufactured complaint" was "unacceptable".
He has also alleged that the police threatened him and were also harassing him as he tried to give a complaint stating there were unnamed persons involved in the firing.
