At a hearing on February 3, Brown's attorney Mark Geragos successfully argued against the LA County District Attorney, Mary Murray's motion that the rapper be locked in the light of a new finding in his pending felony assault case in Washington DC, reported E!Online.
Geragos said that Brown, who had his probation revoked on December 16, is "making great strides" in his programme and did not deserve to have that progress halted.
Brown was ordered on November 20 to spend three months at a residential treatment center.
"I say keep things on a short leash. Keep him where he is now. He is making great strides and all you have to do is look at him, and I've known him for five years. He's as good as he's ever been," Geragos advised the court.
LA Superior Court Judge James Brandlin apparently agreed, but reminded Brown to comply with all the rules set forth by the court, including the order to take his prescription medications and abstain from medical marijuana.
