CJM prays ACJM for proper investigation in assault case

A Chief Judicial Magistrate today moved the court of an Additional Chief Judicial Magistrate praying for proper investigation into a case where the former was allegedly assaulted by a group collecting subscription for Kali Puja on November 8, 2015 here.
A lawyer, Prithwish Ganguli, appeared in the court of Additional Chief Judicial Magistrate [ACJM] Devkumar Goswami on behalf of CJM Indranil Chatterjee with a prayer for proper investigation because his client thought that the police were not investigating the matter properly.
Ganguli told the court that two months have already passed but his client (the CJM) has not yet received a copy of the FIR.
He also appealed to the court to direct the police to provide the complainant with a copy of the statement that was recorded under section 161 of CrPc.
Hearing the plea, the ACJM observed that by not providing the copy of the FIR, the police had insulted CrPc. He, however, said the statement could not be given to the complainant as per law.
Additional Public Prosecutor Lopamudra Das admitted in the court that it was a fault on part of the police and a copy of the FIR would soon be provided.

The court later ordered the Investigating Officer to provide the complainant with the copy of the FIR by 1PM tomorrow and submit another copy to the court with an explanation for the delay.
On November 8, 2015, CJM of Suri court Indranil Chatterjee was allegedly assaulted by a group forcibly collecting subscription for Kali Puja from passing vehicles.
Chatterjee had alleged that he was abused, physically assaulted and his shirt torn by miscreants.
His security person tried to protect him but he too was assaulted. The CJM and his security person filed a complaint at Suri police station.
Next day, the police had arrested four persons who were released on bail after a week. Another four persons were arrested later but they too were granted bail after an identification parade.
