Delhi High Court today gave the city government time till April 15 to comply with its earlier direction to enhance salary of a retired Additional District Judge who is the presiding officer of two appellate tribunals.
A bench of justices Badar Durrez Ahmed and Sanjeev Sachdeva said the court's January 28 order to increase salary of ADJ V K Maheshwari has not been complied with and even the terms and conditions of the posting have not been framed.
"We are told that although some payment has been made, same is not in terms of the order dated January 28. Even the terms and conditions have not been framed. As such, the order of January 28 not complied with in full.
"There is also no reply to the contempt notice issued to Secretary, Finance Department of Delhi government. We give a final opportunity of two weeks to file reply and comply fully with directions of January 28 order," the court said and listed the matter for hearing on April 15.
On March 19, the court had issued a contempt notice to the Finance Secretary of city government for not complying with its order despite repeated warnings.
The court had on March 12 pulled up Delhi government for non-compliance of its January 28 order and warned that it was "contemplating issuing of contempt notices". The bench had, however, given them a week's time to ensure compliance.
The court had on January 28 termed as "thoroughly inadequate" a salary of Rs 35,915 the city government proposed to pay to retired ADJ V K Maheshwari, the presiding officer of Delhi Schools Tribunal (DST) and State Transport Appellate Tribunal (STAT).
It was hearing a plea filed on behalf of Maheshwari by advocate Sanjeev Ralli, in which it has been claimed that the Tribunal head had not been paid any salary since his appointment in May 1, 2014.
