Contempt petition to punish coop bank Special Officer closed

: The Madras High Court bench today closed a contempt petition,seeking to punish a Special Officer of Vallam primary Agricultural Cooperative Bank in the district for not obeying its order, upholding the labour court's order to reinstate a dismissed employee with continuity of service and 50 per cent back wages.
"The High Court had not specifically directed that the award of the labour court should be implemented. In the absence of any specific direction, the petitioner will have to work out his remedy in a manner known to law by invoking Industrial disputes act," Justice S Vaidyanathan said.
The judge said the court was not an execution court and the petitioner cannot seek execution of the labour court award by means of a contempt petition.
"If there was a specific direction by the court to implement the Award of the Labour court,this court would have unhesitatingly taken action on this petition.The Petitioner is granted liberty to agitate the relief available to him under the Award passed in the case in the manner known to law."
Petitioner V Chandrasekaran was dismissed for disobedience of the order by the SO Somuvel on Mar 27 2013. The labour court directed the S.O to reintstate him with continuity of service and 50 per cent back wages.
Both the S.O. And Somuvel went on appeal, the former seeking to set aside the labour court award and the latter seeking full back wages.
