Convicted for robbery, 2 youths freed for time spent in jail

Two youths convicted of robbing and injuring a woman while she was alone at home were handed seven-year jail terms by a Delhi court which then ordered their release on the basis of time already spent in custody.
District Judge Neeraj Kumar Gupta found Ishrar Nabi and Prakash Nathan guilty of trying to strangulate and injuring with a knife the complainant in the case during a robbery bid at her residence in west Delhi. The convicted duo had looted gold and cash during the robbery.
Keeping in view that the duo was behind bars for over seven years in connection with the case, the judge sentenced them to the period already undergone in prison.
"Considering the aspect that both convicts were in judicial custody from Oct. 10, 2006, till date, i.E. For more than seven years, they are sentenced to the period already undergone.
"They may be released if not required to be detained in any other case," the judge said.
The woman had told the police that on Sept. 28, 2006, while she had been alone at home, the said duo knocked at the door and told her that her husband had asked them to visit in connection with a job.

The youths, residents of Delhi, upon being allowed inside requested a glass of water from the woman, police had said.
But when she went to the kitchen to fetch the water, Prakash pulled a wire around her neck while Nabi caught her hands and gagged her.
Later, after having caused her injuries and looting the house, the duo fled the scene, police added.
Police said that a third accused, one Abid Ali, was standing outside the house keeping watch.
However, with no case being made out against him, Abid was acquitted of charges framed by court.
Incidentally, the convicted duo had claimed in court that they had been falsely implicated in the case.
