Court acquits man in rape case after girl turns hostile

A man has been acquitted of the charges of raping and criminally intimidating his 19-year-old sister-in-law by a Delhi court after the girl turned hostile.
Additional Sessions Judge Kaveri Baweja acquitted Sher Singh, a south Delhi resident, saying the girl failed to support the prosecution case and no incriminating material against him could be brought on record.
"Prosecutrix (girl), being the star witness failed to support the prosecution case, in my opinion, no fruitful purpose would be served by examining the remaining witnesses...Their depositions, even if recorded, would also not throw any light upon the offence allegedly committed by the accused.
"As per the girl, no physical relations between her and Sher Singh were ever established. He, therefore, cannot be convicted for offence under Section 376 (rape) of the IPC," the judge said.
According to the prosecution, the girl was allegedly raped by her sister's husband for three months.
The girl had told the police that in February, 2014, her sister was unwell and whenever she visited her house, Sher Singh would rape her and threaten to kill her if she disclosed it to anyone, it said.

The girl said she remained silent as she feared her sister's life would be ruined.
However, the girl changed her statement, saying that Sher Singh was innocent. She told the court that she suffered high blood pressure at her sister's place and stormed out of the house.
The girl claimed she didn't know how she reached the police station and when she began to feel better, she saw Sher Singh in police custody. She requested the police officials to release him, but they refused.
