Additional Sessions Judge Sanjiv Jain freed the man, a Bihar native, of the charges including rape, abduction and criminal intimidation, noting that she was "in love with him" and wanted to marry him but was rejected by his mother as she belonged to a different caste.
"The woman and the accused were friends.... Theylovedeach otherandwanted to marry. Owing to caste castedifferences, the accusedrefused to marry the woman since his mother did not want him to marry with the prosecutrix. She got annoyed and made the complaint," the judge said.
According to the prosecution, the woman had lodged a complaint against the accused, who was her batch mate in a government medical college where they were pursuing a Lab Technician course, alleging he abducted her and raped her at his house after intoxicating her drink on March 18, 2014.
However, during her examination and cross examination, she resiled from the contents of her complaint and denied all allegations of rape or abduction.
The statement of the accused was dispensed with as the court could not find any incriminating evidence against him.
