Additional Sessions Judge Hemani Malhotra acquitted 34-year-old Yogesh of the charge of attempting to murder his wife Rajni under section 307 of the Indian Penal Code (IPC), saying the prosecution has failed to prove its case.
"In the light of testimonies of the victim and other material witnesses, I am of the opinion that the prosecution has miserably failed to bring home the guilt of Yogesh under section 307 of the IPC and therefore, I have no hesitation to acquit him.
According to the prosecution, Rajni's father Ashok Singh had lodged an FIR stating that a quarrel broke out between Yogesh, who was in a drunken state, and Rajni in the wee hours of April 28, 2012 after which the man informed him that she had consumed insecticide accidentally. She was rushed to St. Stephen's Hospital immediately.
