"I have not closed the door. You please go through my order and do not come to any conclusion before that. I have not said that I will not summon the Army Chief.

"I have kept it open and has called for the file as I think it is necessary for me to go through the file of press release before passing order on the point of summoning them," Metropolitan Magistrate Jay Thareja said.

The court made the remarks after it was told by Tejinder Singh that it seems "no one can touch him," till he (the Army chief) is holding his post. Tejinder Singh has sought prosecution of Army chief and four others for allegedly defaming him.

Tejinder Singh's counsel Anil Aggarwal said this after the court pronounced its verdict that it will hold an inquiry into the allegations levelled against the Army chief before passing any order on summoning him.

"I am sorry to say and I know that I am saying it without going through your order that it seems till the time Gen V K Singh is holding the post of Army Chief, no one can touch him and nothing can happen to him," the counsel told Metropolitan Magistrate (MM) Jay Thareja.

The court also told Tejinder Singh's counsel that he is free to appeal against the order, if is not satisfied.
