Court directs engineer to pay Rs 6K monthly alimony to wife

Metropolitan Magistrate Savitri has ordered Uttar Pradesh resident Bhudev Gupta, working as a civil engineer with N K G Infrastructure Ltd here, to pay the maintenance amount to his wife by the 10th of every month.

"Keeping in view the income of the respondent and the modern cost of living and all other circumstances of the parties and further keeping in view that petitioner (woman) is capable of earning, I order the husband to pay a sum of Rs 6,000 per month to his wife...," the magistrate said.

The court's decision came on the plea of the woman, who had pleaded before the court that she was treated with cruelty by her husband and his family members.

After repeated incidents of cruelty, the woman had lodged a complaint against her husband, for which she was thrown out of her in-law's house in July 2008, she said.

"All her dowry articles were illegally retained. She is at the mercy of her parents and has no means of maintenance," the woman's counsel had said in the complaint seeking alimony.

The counsel further stated that all the demands of the woman's husband and her in-laws were fulfilled since the wedding which took place in February, 2008.

Gupta opposed the alimony demand on the grounds that his wife, having a post graduate degree, is highly qualified and capable of getting good employment.

Brushing aside his contention, the court said, "In view of unrebutted, unchallenged and uncontroverted testimony of the petitioner (woman), I believe her version."

"Payment shall be made by 10th of every month by money order or be deposited in the bank account of the petitioner," the magistrate added.
