Court frames charges against 3 cops for giving false evidence

Three Delhi Police officials were today put on trial by a court here for allegedly giving false evidence against a father-son duo to get them convicted in a 2002 case.
Additional Sessions Judge Daya Prakash framed charges against Delhi Police Inspector Ashok Kumar, SI Sunil Jain and SI Sandeep Sharma and fixed the matter for recording of prosecution evidence on September 3.
A criminal case was registered against the three cops on the order of the Delhi High Court which had directed proceedings against them for allegedly giving false evidence against south Delhi resident Manjeet Singh Chug and his father Mahender Singh in a case of attempt to commit culpable homicide.
"In my opinion after directions of Delhi High Court vide order dated June 21, 2010 and finding a prima facie case against accused persons (cops), charges under sections 193 (punishment for false evidence) and 195 (giving or fabricating false evidence with intent to procure conviction of offence punishable with imprisonment) IPC are required to be framed against accused.
"Accordingly, let charges under sections 193 and 195 IPC be framed against accused persons Inspector Ashok Kumar, SI Sunil Jain and SI Sandeep Sharma," the court said.
While acquitting Chug and his father in the criminal case registered against them, the high court had held that it was an "outcome of rivalry" between them and the police officers.
The high court had set aside the order of a magistrate convicting Chug and his father in the case.

During arguments on framing of charges, counsel for the cops had said that the high court order had not named them as accused and Chug's appeal was not decided on merit.
The prosecutor, on the other hand, had argued that this case has arisen out of order of the high court by which it had directed to start proceedings against these three cops.
He had said charges have to be framed and any merit and demerit has to be seen after leading of evidence by the prosecution and the accused.
