Court intimates MCI about criminal case against doctor

Taking cognisance of the charge sheet against the doctor of a private hospital, Metropolitan Magistrate Ekta Gauba sent an intimation to the MCI, a statutory body which registers doctors practicing in the country.

"I take cognisance of the offence under section 354 IPC (assault or criminal force to woman with intent to outrage her modesty).

"Intimation of the present charge sheet be sent to the MCI through the investigating officer concerned," the court said.

The police had registered a case against the doctor working at Sonia Hospital in West Delhi.

The case was registered on a complaint of 20-year-old girl, a BA second year student of Delhi University.

The girl had told the police that on December 9 last year she was taken to Sonia hospital by her father and brother after she had consumed a poisonous substance by mistake.

She said she was admitted in the Intensive Care Unit of the hospital where she was being treated by the accused doctor.

On the intervening night of December 9 and 10, 2011, the accused doctor came to check her health condition and on the pretext of attending to her, he started touching her in an indecent and objectionable manner and even kissed her, the police said in the charge sheet.

The girl also told the police since she was still under the effect of the poisonous substance, she could not protest and after a while the doctor went away.

The next morning the girl narrated the incident to her family, who reported the matter to the police. The accused doctor was arrested and is currently out on bail.

The court has also issued summons to the accused doctor returnable for March 11, 2013.
