Metropolitan Magistrate Aanchal issued notices to the investigating officers in the two cases after they failed to appear before the court in response to its earlier notices and summons.
"Both investigating officers (IOs) of FIR No. 182/12, 197/12 (both cases of theft) of police station Moti Nagar have not appeared despite service. IO of FIR No. 182/12 is reported to have gone to Meerut, UP, though the summons was received by him.
"It appears that both IOs are not willing to appear in the court intentionally. Issue notices under section 60/122 (relating to misconduct by a police officer) Delhi Police Act against both IOs," the MM ordered.
The court order came after accused Rajendra and Sarfaraz, arrested on December 1 in motorcycle theft cases, told the judge that they were mercilessly beaten up by the policemen in civil dresses at Moti Nagar police station.
Their counsel from Delhi State Legal Services Authority, N K Saraswat, told the court that the accused had been harassed and tortured physically and showed it various injuries on their bodies.
The court had then ordered their medical examination and noted that the test report showed swelling and other injuries on their body.

Observing that "an inquiry was necessary in the matter," the court has now fixed the case for hearing on January 4.
The matter had come to light when the accused were remanded in judicial custody where they complained of custodial torture in the police station.
