Court recommends 5-yr-old rape victim's case for compensation

Additional Sessions Judge Narinder Kumar recommended grant of compensation to five-year-old girl, while sentencing her rapist to seven years in jail.

The court recommended the case of minor victim, raped in 2010, for compensation under the Delhi Victim's Compensation Scheme, 2011, which was approved by the Delhi government on May 14 for victims of rape, acid attacks, human trafficking, child abuse and kidnapping.

"Recently, the Government of NCT of Delhi has approved Delhi Victim's Compensation Scheme, 2011 for the purpose of providing compensation to victims who have suffered loss or injury as a result of offences including sexual offences.

"Keeping in view the injury suffered by the victim and that the convict may not adequately compensate the victim for the injury to her person and her modesty, this court deems it a fit case to recommend her compensation," the ASJ said.

The five-year-old girl was raped by a rickshaw puller, Trilok Thakur alias Mota, in the wee hours of November 6, 2010, a day before Diwali.

The girl used to reside with her parents and three siblings in a park near Jama Masjid and used to beg for survival. Accused Thakur, a native of Bihar, also used to sleep in the same park.

On the night of the incident, the minor victim came weeping to her mother who was asleep. When she woke up, the girl narrated her the incident. She was profusely bleeding from her private parts.

The girl's parents nabbed Thakur the next morning and handed him over to police.

Considering the medical examination report, the victim's testimony and other evidence, the court held him guilty.
