The order was passed by special judicial magistrate (CBI) Neelkant Mani Tripathi.
While CBI had termed Sachan's death as homicide, the Deputy CMO's wife, Malti Sachan, had filed a protest application alleging that it was murder.
V K Shahi, counsel of Malti, said that in earlier hearings, the court had heard arguments of both the sides and reserved his decision.
Sachan was found dead inside the toilet on the first floor of the district jail on June 22, 2011 and the post mortem by a panel of doctors had found injuries and one ante mortem injury.

Closure report filed in the court had said during the investigation that no evidence had come on record indicating death of Sachan to be a homicide.
It said that no evidence pointing towards presence of a second person in the toilet at first floor of jail hospital had come forth during the investigation.
The evidence collected during investigation including statements of witness, expert opinions of board of directors of AIIMS, New Delhi, the reports of CFSL, experts in the fields of biology, finger print, hand writing, chemical examiner, forensic psychologist all indicate that Sachan had committed suicide, the agency had said.
