Court sentences youth to 2 yrs jail for possessing opium straw

The court convicted 29-year-old Avatar Singh, a resident of Punjab, observing that the forensic report as well as the statement of the prosecution witnesses clearly establish that he was carrying intermediate quantity of the contraband.

"There is no reason to discredit the depositions of the witnesses or the documents prepared at the time of recovery.

"The FSL (forensic) report has also confirmed that the contraband recovered from the accused (Singh) is poppy straw," additional sessions judge Anju Bajaj Chandna said and also imposed a fine of Rs 20,000 on Singh.

The court, however, enlarged Singh on bail on a personal and surety bond of Rs 15,000 after he moved an application for filing an appeal against his conviction.

According to the police, Singh was arrested near the ISBT flyover here with two bags carrying 18 kg of opium straw.

During the trial, Singh had claimed innocence saying that he was sitting at near ISBT flyover and the police came there and lifted him without any reason.

Singh's lawyer told the court that his client was falsely implicated by the police and there were no public witnesses in the case.

The court convicted Singh relying on the forensic report, statement of the police officials and said he had failed to attribute any reason for his false implication.

"The convict stands convicted for the offence punishable under the Narcotics Drugs and Psychotropic Substances Act. Keeping in view his age and clean antecedents, I sentence convict Avtar Singh to rigorous imprisonment for two years and fine of Rs 20,000," the court said.
