The film's publicity poster, showing Khan in the buff on railway tracks, is "obscene and vulgar", says the plaintiff Hemant Patil.
The court today said it would frame issues on December 17 as to whether it has the jurisdiction to entertain this suit. It asked the plaintiff's lawyer, advocate R N Kachave, to argue on whether a case of obscenity/ vulgarity was made out.
Khan, a good actor who hosts the popular TV show 'Satyamev Jayate', has a good and clean public image, but by appearing nude in the poster he has committed "a shameful" act, Patil contended.
The Supreme Court had recently dismissed a public interest litigation which sought a ban on the poster on the same ground. "If you don't like then don't watch the film," the judges had said.
