Dismissing an election petition filed by defeated candidate Rama Eramanathan of AIADMK, Justice R Mala said the petitioner had not proved the 'corrupt practices' allegedly indulged in by the winning candidate.
"The election petitioner has failed to prove the corrupt practice alleged to be committed by the returned candidate in accordance with law", she said and dismissed the petition.
Anbalagan won the polls defeating Rama Eramanathan by a margin of 1,272 votes and was declared elected.
His election was challenged by way of an election petition by Rama Eramanathan who alleged the DMK candidate had won the polls by 'inducing' electors through bribery and as such committed corrupt practices for his success.
The Judge, while declaring that the election petition was filed well within a period of limitation as prescribed in the Representation of Peoples Act, rejected the charges of corrupt practice by the defeated candidate as they were not proved by the election petitioner in accordance with law.
