Decide how to deal with unauthorised colonies or bring UD

"Stick out your neck" and take a decision, the Delhi High Court today told the Centre giving it the option of deciding how to deal with unauthorised colonies or to ensure the presence of its Urban Development (UD) Secretary on the next date of hearing to explain why nothing has been done.
A bench of justices B D Ahmed and Sanjeev Sachdeva gave the options to the Ministry of Urban Development (MoUD) after having directed it on February 4 to finalise policy on regularisation of unauthorised constructions in the city by March 25.
"Why don't you take a decision? Why are you afraid? Stick out your neck. Take a practical view," the bench told the government and then joked that the ministry does not want to decide "as some of them live there".
"Sainik Farms is completely illegal.It is an unauthorised colony. What do we do with such colonies, either demolish each and every house there or else regularise them," it said, while giving the government time till May 20 to take a decision, "which it should have by now".
Meanwhile, in a related matter pertaining to residents of the Defense Services Enclave (DSE) there, the court said the people there were retired army officers, war widows and descendants of armed forces officers who "belong to a entirely different class and prima facie cannot be termed as affluent persons".
"It is, therefore, directed that Central government shall take a clear decision on regularising the Defense Services Enclave before next date of hearing on May 20," the court said.
The bench made the observation after the government said according to a Central government notification unauthorised "affluent" colonies cannot be regularised and the DSE is one such place.
The court while disagreeing with the submission told the authorities to not club the DSE residents with other people living in Sainik Farms.
