The Bombay High Court has directed jail authorities to decide within two weeks an application filed by Kersi Adjania, convict in the 1993 serial bomb blast case, seeking early release on grounds of failing health.
82-year-old Adjania had approached the high court after the Nashik jail superintendent failed to pass an order in an application filed by him on January 18 seeking special remission.
According to Adjania's lawyer N Gavankar, the jail authorities have special power to pardon one month of the sentence as remission.
"Adjania was sentenced to one year imprisonment, of which, he has already undergone 11 months. He is unwell and bound to a wheel chair. He recently fell in jail and underwent a hip joint surgery," Gavankar said.
A division bench of Justices N H Patil and V L Achliya directed the jail authorities to consider and decide the application within two weeks.
Adajania was also convicted by the trial court for destroying the AK-56 rifle possessed by actor Sanjay Dutt.
