Decide on framing charges against Yadav in 30 days: HC to CBI
Press Trust of India Chandigarh The Punjab and Haryana High Court has asked the CBI court here to decide on framing charges against former judge Nirmal Yadav in the 2008 cash-at-judge's door case within 30 days and dismissed her plea seeking photocopies of her prosecution sanction records.
Justice Paramjit Singh in the order yesterday said that (Retd) Justice Yadav can inspect the record in CBI court within 15 days and asked the trial court to take a decision on framing of charges against her within 15 days thereafter.
Yadav's counsel had contended that in the case of voluminous record, supply of copies was the only solution instead of inspecting the documents.
It was argued that the very fact that inspection of documents had been allowed indicated that the papers did not fall in the category of privileged or classified documents and the non-supply of the same would be against the principals of natural justice as those would be relied upon by the prosecution during the trial.
The CBI court had earlier dismissed Yadav's plea in this regard. The CBI had opposed her demand for supply of documents on the ground that code of criminal procedure did not permit it.
The CBI had filed the charge sheet against the former judge in March 2011.
The Punjab and Haryana High Court was rocked by the controversy after a sum of Rs 15 lakh was delivered at the residence of Justice Nirmaljit Kaur, another judge of the High Court, on August 13, 2008, following which she reported the matter to Chandigarh Police.
The money, allegedly meant for Yadav, was said to have been delivered to Kaur due to confusion over their names.
