Sir Ganga Ram Hospital today informed the Delhi High Court that more tests are required to be carried out before performing the kidney transplant surgery of a man, who had filed a petition that his operation has not been conducted despite having all necessary approvals.
On the basis of the statement by the hospital, a bench of Justice Vibhu Bakhru, disposed off the petition and directed petitioner Amit Prakash Aggarwal, who is suffering renal failure, to go to the concerned doctor today itself, so that the required test could be carried out.
Aggarwal had moved the court apprehending his surgery might not be conducted before the expiry date of the financial assistance from Prime Minister's Fund in September.
"Respondent 1 (Ganga Ram) has no objection in conducting surgery for organ transplantation..Further tests are required. The grant will expire shortly. It is necessary to conduct the tests as expeditiously as possible.
"The petitioner (Aggarwal) shall remain present today at first instance. The hospital will see that surgery is performed as soon as possible," the bench said.
Meanwhile, on the issue of expiry of the financial assistance from the Prime Minister's Fund (PMF), central government Standing Counsel Anil Soni and advocate Naginder Benipal said that there was no expiry period mentioned in the letter sanctioning the amount of Rs three lakh.
The court asked Aggarwal's counsel to give representation before the PMO if the sanctioned amount was expiring in September and the PMO will decide whether to extend it.
Aggarwal, who is on dialysis, had moved the court seeking that the transplant be carried out before September when the financial assistance of Rs three lakh received from PMF will expire.
