During a discussion in the Assembly, over Lt Governor Anil Baijal's 'message' regarding withdrawal of powers to the departmental committees formed by it, Leader of Opposition Vijender Gupta alleged that the panels were enjoying powers that were not available even to those of Parliament.
The Delhi Assembly constituted a nine-member committee that will look into the "unconstitutionality" of the message by Baijal. It will also examine the L-G's "concerns" regarding functioning of the departmental committees of the House.
"The DRSCs violate constitutional provisions. They have been given more powers then the Lok Sabha committees," Gupta said.
Citing the Government of National Capital Territory of Delhi (GNCTD) Act, the BJP leader backed the L-G's message saying he has the "right to exercise his discretion".
He said, "Rule 41 of GNCTD Act lays down that the L-G will act in his discretion in matters which fall outside the purview of the powers conferred on the Assembly or in which he is required by or under any law to act in his discretion or to exercise any judicial functions.
