It also rejected the contention of the accused that they were falsely implicated by the victim because he wanted to grab their property, saying no ordinary person can think of grabbing the property of accused knowing fully well that he is employed in Delhi Police.
Additional Sessions Judge Sandeep Yadav handed down the jail term to policeman Nathu Ram and his brother Virender, 40, while relying on testimonies of victim Vineet Kumar, his father and uncle, who had seen the duo assaulting him.
The court, while relying on the witnesses' statements, also noted that the motive of the accused to commit the crime was to force Vineet to hand over the papers of his car to them as they wanted to purchase it.
"Hitting the injured on head with stone causing grievous injuries to Vineet on face and other parts of body make both accused persons liable under section 307 (attempt to murder) of IPC," it said.

The court also rejected the alibi taken by the Nathu, who had claimed that he was on police duty in Model Town here at the time of the incident.

According to prosecution, Vineet was hit by a stone on the night of October 8, 2008 by the cop and his brother and received grave head injuries.
He was taken to a hospital where he remained unconscious for over six months, it said, adding that the duo was handed over to police by victim's father who was an eye-witness.
During the trial, Virender, who works at Nasha Mukti Kendras to guide people against intoxication, and Nathu had claimed that they were innocent and had already spent considerable time in jail.
