Special Judge B R Kedia absolved Sub Inspector Ashok of the charges of accepting Rs 1,000 as bribe on complainant Satish Kumar Chauhan's deposition that the sub inspector had not taken any illegal gratification to provide him the report to lodge insurance claim for his stolen motorcycle.
"It is reflected that Satish Kumar Chauhan who is the complainant has not supported the stand of the prosecution and has not deposed anything as regards the demand and acceptance of bribe as against the accused.
"Complainant has categorically deposed that the accused was not ready to accept the bribe amount and even threw away the same. The prosecution has failed to establish its case against accused Ashok," said the court, acquitting Ashok.
According to the prosecution, Ashok was caught red-handed by the Anti-Corruption Branch (ACB) sleuths on November 17, 2009 while accepting the bribe from Chauhan at a police station in Central Delhi.
The accused, on the other hand, had argued that he had been falsely implicated. He pleaded that he had already delivered the report demanded by the complainant to another police official and there was no opportunity for him to demand or accept the bribe.
During the hearing of the case, Chauhan had testified that the accused had not demanded any bribe from him.
