Two developers arrested in the Shil-Phata building crash in the city which claimed as many as 74 lives have sought bail on the grounds that the police failed to file any chargesheet against them within 60 days of detention.
Prominent criminal lawyer Majeed Memon who appeared for the two developers Salim Shaikh and Jamil Qureshi, who are the main accused, brought to the notice of Special Judge K R Warrier that they were arrested on April 6, and a period of 60 days are already over.
"As the prosecution has not filed its chargesheet in court against the accused within 60 days, bail should be granted," he told the court.
Memon told the court that their case came under the second provision of Section 167 of the Criminal Procedure Code and hence they are eligible for bail.
The court's decision will have a binding on the other accused who have also filed bail applications and whose chargesheets have not not been filed as yet.
