Additional Chief Judicial Magistrate Randhir Verma, while delivering his verdict in the case, observed that the prosecution failed to proved its case beyond reasonable doubts.
According to the public prosecutor, the accused Dr. Randeep Singh Rana, who was running the hospital here, had conducted the hernia operation on Ashwini Kumar on April 28, 2011. However, the victim died during the operation.
Ashwini, during operation, as per police, sustained six centimeter surgical wound. During post-mortem, it was found that the abdomen cavity was full of blood.
Later, the accused filed a revision petition before the Punjab and Haryana High Court and the case was changed to 304-A (causing death by negligence) of IPC.
