Drunken driving: Court upholds man's 10-day jail term

A Delhi court has refused to reduce the 10-day imprisonment awarded to a man for drunken driving, saying he has not shown any remorse for his conduct.
The court dismissed the appeal of 40-year-old Gulab Singh filed against a magisterial court order awarding him 10 days jail term and directed that he be taken into custody to serve the sentence.
"Driving or manoeuvring a vehicle on road requires good observation, clear thinking, quick decision and timely neuromotor response. A driver is required to be both mentally and physically fit. With such high alcohol content in the blood, as in the case of the appellant, mental faculties of a person are likely to get impaired," Special Judge Rakesh Syal said, while upholding the sentence.
The judge said the magisterial court had rightly declined the benefit of probation to Singh and the sentence awarded to him appeared to be appropriate.
According to the prosecution, Singh, a professional driver was driving a commercial Light Goods Vehicle during night in a drunken state and the alcohol content in his breath analyser test was found to be 10 times higher of the permissible limit.
It said when he was signalled by the cops to stop on the night of February 26, he tried to flee and was chased.

He was caught and a case was registered against him. Singh pleaded guilty before the trial court and was awarded 10 days jail along with a fine of Rs 2,000.
Aggrieved by the trial court verdict, he challenged the jail term saying the alcohol content in his blood was not too high and the company of hard core criminals in jail may spoil his entire life.
He sought leniency saying he was the sole bread earner in his family and has to support his wife and two school going children.
The sessions court, while dismissing his appeal, said "The concomitant circumstances of this case makes the offence serious. He is a mature person responsible for all his actions. From the order of the trial court, it appears that he has not shown any remorse for his conduct".
