Drunken driving: Man sentenced till rising of court for 5 days

A Delhi court has sentenced a man till rising of court for five days for driving under the influence of alcohol, saying roads in the national capital have become one of the most dangerous stretches due to "increasing instances of drunken driving and fatal accidents".
Additional Sessions Judge Hemani Malhotra modified the trial court order, which had sent Delhi resident Amit Kumar to 10 days in jail and imposed a fine of Rs 1000, to five days till the rising of court considering the fact that he was the only bread earner of the family.
"The impugned order qua simple imprisonment for 10 days is modified to the extent that convict shall undergo TRC (till the rising of court) for five days. Convict is directed to undergo TRC for five working days," the court said.
The judge ordered him to appear before it from today till November 21 at 10 AM sharp and to leave the court at 5 PM and directed the court staff to maintain his attendance record.
"It goes without saying that roads of Delhi are one of the most dangerous stretches ever known, owing to increasing instances of drunken driving and fatal accidents," the court said.
Kumar had appealed in the sessions court against the trial court order on sentence saying that it was very harsh and the offence was minor in nature.

The sessions court also observed that for the first offender, the sentence imposable is upto six months jail and fine upto Rs 2000 but the sentence of 10 days awarded to Kumar appeared to be on extremely lower side.
It also said that the alcohol detected in the blood of the convict was 114.3mg/100 ml and by such act, he had not only put his life in danger but also the life of other road users.
According to the prosecution, on September 6, this year, Kumar was found driving his car in an inebriated state by the police at SPM Marg here.
Kumar then pleaded guilty before the trial court which convicted him for various offences under the Motor Vehicles Act and sentenced him to 10 days simple imprisonment and Rs 1000 fine.
