Holding courier firm guilty of rendering deficient service and damaging the equipment by its "careless handling," the East Delhi District Consumer Disputes Redressal Forum said DTDC was "under the obligation to reimburse the total cost of the loss sustained" by its customer.

The forum's order came on plea by Laxmi Nagar-based firm, Nugen Scientific, which had alleged that the lab equipment it had sent through DTDC to Birla Institute of Scientific Research Science and Technology had been delivered in a damaged condition.

The firm, engaged in manufacture and export of laboratory and scientific instruments, had said the equipment which was worth Rs 2,97,360 was fully insured by it by paying a amount of Rs 6,395 to the courier company.

DTDC was proceeded against ex-parte as it did not appear before the forum.

"It is a clear case of deficiency in services on the part of the respondent (DTDC) and this is so evident from their letter wherein they say that they are not in possession of any detail regarding the said consignment.

"The allegations in the affidavit are not controverted. The overwhelming evidence on record clearly shows that the consignment was damaged due to careless handling of the respondent," the bench presided by N A Zaidi said.
