Earlier order also apply to insured houses: HC

The Jammu and Kashmir High Court today said its earlier direction of providing interim relief to flood-affected businessmen by the insurance companies shall also apply to insured houses and motor vehicles.
"We wish to observe that the order shall also apply to the properties and houses which have been completely damaged by the floods.
"Additionally, those orders shall also apply to insurance involving motor vehilces," a Division Bench comprising Chief Justice M M Kumar and Justice Ali Mohammad Magrey said referring to its September 26 order.
The court had directed that claimants in case of policies involving Rs 25 lakh or less and amount exceeding Rs 25 lakh shall be entitled for 95 per cent and 50 per cent amount respectively.
"In respect of insurance policies involving Rs 25 lakh or less, we reiterate the court order dated 26.09.14 and 95 per cent of the assured amount shall be paid as has been directed," the bench observed.
The court expressed dissatisfaction over the pace of settlement of claims saying time is the crucial factor and practically it is not possible to depute adequate number of surveyors for such a large number of claims which may take years.
"Reports of companies reinforce our view that dependence on preliminary survey reports is likely to take long time as has been observed in earlier order," the Bench said.
