"A perusal of the evidence brought on record in the course of trial indicates not only falsity of the claim of the prosecutrix, but also points out towards innocence of the accused.
"The case in hand is a fall out of love affair between the accused and the prosecutrix and by no stretch of imagination, accused can be convicted on the charges of rape," Additional Sessions Judge Kaveri Baweja said.
"It is crystal clear on going through the material on record, including the video clip of the accused and the prosecutrix of March, 2013, the photographs which are screen shots of said video clip, call detail records of accused and the prosecutrix besides other evidence that they were engaged in consensual physical relationship with each other," the court said.
According to the prosecution, the accused who worked as a property dealer had given some stupefying drugs to the woman mixed in a cold drink and raped her.
The accused had denied the charges in the court and pleaded not guilty. He had claimed that they were in a consensual relationship and after his wife had got to know about their affair, he stopped talking to the woman.
He further claimed that after he had stopped talking to her, the woman quarrelled with him and had lodged a false rape case.
