Metropolitan Magistrate Abhilash Malhotra granted the relief to the MLA from Sadar Bazar on a personal bond of Rs 10,000 and a surety of a like amount after he assured the court that he would not flee from justice and has deep roots in the society.
The case was filed by BJP member Praveen Jain, who had contested from the same constituency in 2015 Delhi elections.
However, he was availing the benefits and reimbursements of Delhi Employees Health Welfare Scheme (DEHWS) by declaring his parents as dependants, it alleged.
"It is alleged that he intentionally suppressed the information and caused wrongful loss to the government exchequer. Offences of forgery and giving false information by way of sworn affidavit are made out," the complaint alleged.
The court had on April 26 this year framed charges against Dutt for the offences under section 125A (penalty for filing false affidavit) of the Representation of the People Act (RPA) and sections 177 (furnishing false information), 181 (false statement on oath or affirmation to public servant) and 199 (false statement made in declaration which is by law receivable as evidence) of the IPC.
