MACT directed the New India Insurance Company, with which the bus was insured, to pay a compensation of Rs 21,26,344 to the wife and two children of deceased Inderjeet Singh who worked as a Peon in DAV School, Pitampura.
While awarding the compensation, MACT Presiding Officer Barkha Gupta said the bus driver was driving in a rash and negligent manner and hit the bike on which Inderjeet was riding pillion, causing his death.
According to the family members of the victim, on the evening of June 4, 2009, Inderjeet was returning home on the bike of his colleague when the two-wheeler was hit by the bus and they both fell down and sustained grevious injuries.
Relying on the testimony of Inderjeet's wife Satwanti, the Tribunal said the "petitioner's (Satwanti) testimony was sufficient to establish the case and prove the accident and the cause of death of the victim and hence it did not matter if the postmortem was not conducted.
