MACT Presiding Officer Arun Bhardwaj directed Oriental Insurance Co Ltd with which the offending vehicle, a WagonR, was insured to pay the compensation to the widow and children of 51-year-old Gaj Ram, a resident of West Delhi.
"Total compensation payable to the petitioners (family of deceased) would be Rs 30,58,884... Insurance company has not put up any defence. Therefore, compensation is to be paid by insurance company," the tribunal said.
According to eyewitnesses' testimonies, victim Gaj Ram was riding his motorcycle near sector one red light at Dwarka here at 6.15 am on July 10, 2011, when a speeding WagonR hit his two-wheeler from behind due to which he fell down and came under the car's wheels.
He was taken to Deen Dayal Upadhyay Hospital in the offending vehicle itself, but after getting to the hospital the driver had fled away, the prosecution had said.
Gaj Ram succumbed to his injuries suffered in the accident, it had added.
The car was being driven by one Ajay Aggarwal, a resident of Dwarka here, who had contended in his written statement that no accident was caused while he was driving the alleged offending vehicle and that the family of the deceased were levelling baseless allegations to extort money.

He had said when he had reached the accident spot, he found Gaj Ram already in injured condition and the motorcycle parked by the road side, adding that on a request by a person standing there, he had taken the injured to DDU Hospital for urgent and immediate medical help.
The tribunal, however, passed a verdict in favour of the deceased's family, relying on the testimony of eyewitnesses who had said they saw Aggarwal's car hit Gaj Ram from behind and they had taken the victim to the hospital in the offending vehicle.
