Family of road mishap victim gets around Rs 10L compensation

Family members of a 45-year-old man, who died in a road accident here after being hit by a rashly-driven truck, have been awarded a compensation of around Rs 10 lakh by a Motor Accident Claims Tribunal (MACT).
MACT Presiding Officer Kiran Bansal directed ICICI Lombard General Insurance Co Ltd, insurer of the offending truck, to pay Rs 9,77,904 to the wife, mother and daughter of Vir Pal, who suffered fatal injuries in November 2011.
"From the statement of Ombir (eyewitness) and in view of the criminal case record, it is proved that the deceased Vir Pal sustained fatal injuries in the accident due to rash and negligent driving of offending vehicle...," the tribunal said.
"Award is passed directing ICICI Lombard General Insurance Co Ltd to pay to the claimants/petitioners (deceased's kin) a sum of Rs 9,77,904," it said.
According to the complaint, on November 18, 2011 while Pal was going to a nearby village in district Baghpat of Uttar Pradesh on his bicycle, a truck being driven in rash and negligent manner, hit him from behind.
Due to the impact, he fell down and received grievous injuries. Later, he was taken to a hospital where he was declared brought dead.
The driver of the truck, did not appear before the court and was proceeded ex-parte.
The tribunal also allowed the insurance firm to recover the compensation amount from the owner and the driver of the truck as they did not deny the firm's claim that the driver was not holding valid driving licence at the time of the accident.
