K Thandabani, a former Indian Army official, had on February 14 lodged a police complaint against Vijayakant for prefixing the army rank "Captain" in his name.
Since no action was taken by police on his complaint, he moved the High Court for taking action against the actor.
Justice C T Selvam also directed Thandabai to furnish a fresh copy of complaint to police.
"Police are directed to follow the dictum laid down by the Supreme Court in letter and spirit and shall not give room for any action at the hands of this Court" the judge said.

Thandabani in his complaint to police contended that "Captain" is a higher rank in the Indian Army.
"Though Vijayakant had not served in the army, he was using the higher rank (Captain) before his name in a fraudulent manner which is illegal and an insult to the honour and respect of Indian Army," he said.
