Govt appeals on judge's directive to assembly committee

The writ appeal by the state legislative assembly secretary submitted that the judge had failed to consider that the law of privileges is a special law governing Constitutional Rights and any person accused of breach of privileges or contempt has to respond to the notices sent by the committee and sought to set aside the order.

The First Bench, comprising Acting Chief Justice Elipe Dharma Rao and Justice Aruna Jaagadeesan,directed the Advocate General to submit on February 4, the guidelines for procedures to conduct Privileges Committee proceedings.

They also directed the state Legislative Assembly Secretary to appear before the court to assist it.

Justice K Chandru had on January 21 allowed 'Nakkeeran' Gopal and advocate Edwig's petitions and directed the state Committee to permit Gopal to appear with an advocate of his choice in the proceedings pending before the committee.

They had challenged the proceedings of Tamil Nadu Legislative Assembly Secretary dated Jan 28 2012, asking Gopal to appear before the Privileges Committee to give a statement in writing for giving an explanation to the show cause notice issued by the Committee.
