The CBI filed a memo in this regard before the special CBI court and requested the court to take cognisance of the offences of criminal misconduct punishable under 13 (2) read with 13 (1) (C) and (d) of Prevention of Corruption Act also against Brahmananda Reddy in the case.
Bramhananda Reddy (presently under judicial custody), who was a former Andhra Pradesh special secretary, was arrested on May 15 by the CBI along with industrialist and promoter of Vadrevu and Nizampatnam Port Industrial Corridor (VANPIC) project, Nimmagadda Prasad for his alleged role in helping Jagan in amassing wealth disproportionate to his known sources of income.
Bramhananda and Prasad are among the 14 charge-sheeted accused in the VANPIC aspect of the Jagan case.
It is mandatory for the investigating agency to seek prosecution sanction against bureaucrats/public servants from the government/ competent authority for the court to take cognisance of the charge sheet to prosecute under the Prevention of Corruption Act.
The court had earlier taken cognisance of the offences against Brahmananda Reddy on charge of criminal conspiracy, cheating and under relevant sections of the IPC.
However, with the sanction order pending, the court had not taken cognisance of the sections under the PC Act.

The CBI submitted before the court a copy of the sanction order to prosecute the IRAS officer.
