A bench of Chief Justice G Rohini and Justice Rajiv Sahai Endlaw, on being told that a similar plea had earlier been dismissed by it, asked the counsel for the Delhi government to furnish the copy of that judicial order.
"You (Delhi government) provide us the copy of the order and you also provide us the copy of the notification," it said and fixed the PIL, filed by Amit Bhagat, for hearing on November 12.
It has said that the transport department notification, issued on August 28, was "illegal" and "unconstitutional".
"The impugned notification seeks to amend rule 115(2) of the Delhi Motor Vehicle Rules, 1993 which hitherto exempted all women from wearing helmets when driving or riding pillion on a motorcycle, to allow the exemption from wearing a helmet only to Sikh women.
