"Our experience and facts reveal that professional hands with experience in conducting cases in the High Court are not preferred in the selection of government pleaders and majority are selected out of political and other considerations," Justice Harun AL-Rashid said.
The observations were made while considering a petition to condone 451 day delay in filing an appeal against acquittal of two accused in a spirit trafficking case at Quilandy in 2008. About 1050 litres of spirit was seized by Excise officials from the accused.
The court said 'there is a battery of 138 GPs and Public Prosecutors in the High Court.Despite this,it is not known why matters are not prosecuted in a proper manner and on time".
"It is a matter of concern for the judiciary that when sufficient members of GPs are available in the High Court, propriety requires handling of cases seriously and vigilantly. So many matters are filed with inordinate delay, which results in dismissal without going into merit," the court said.
