The CBI, which is probing the case, however, has opposed the plea claiming that the notes were bribe money which are important evidence of the case and if deposited in bank, it will damage the prosecution case as these are yet to be exhibited before the court.
The cash was seized by the CBI on April 22, 2010, from the alleged middleman J P Singh. The proceedings in the case have been stayed by the Supreme Court on an application filed by one of the accused.
According to the charge sheet filed by CBI on September 16, 2011, Desai entered into criminal conspiracy (under section 120-B of IPC) with other accused persons for bribe to show favour with regard to permitting the medical college to recruit a fresh batch of students without having the requisite infrastructure.
The CBI had claimed that Desai misused his official position by sharing the information regarding the inspection pertaining to grant of permission to the college.
