Justice K S Jhaveri, while granting bail, noted that he had already served half of the maximum sentence prescribed for the offence.

Sylvester is one of the important witnesses in the Sohrabuddin Sheikh fake encounter case and his testimony has exposed the alleged role of former Minister of State (Home) Amit Shah.

The bail was granted with the condition that he would not leave Gujarat, said Sylvester's lawyer Soeb Bhohiria.

Sylvester's contention was that trial had been delayed for no fault of his and he was languishing in the jail.

In the present case, he is accused of firing shots at the office of Popular Builders' office in Navrangpura in December 2004, along with Tulsiram Prajapati.

He had got bail earlier, but was arrested because he produced a bogus surety. Last October, he gave slip to the police escort team from Udaipur, where he had been taken in connection with another case. He was nabbed the next day.

According to CBI, which has probed the fake encounter, the 2004 firing incident had been staged by police themselves, so as to frame up Sohrabuddin. CBI wants to probe the firing case, and its petition seeking transfer of probe is pending before the Supreme Court.
