HC allows lifer to go on parole to attend mother's surgery

The Madras High Court has allowed a life convict to go out on parole to attend the surgery on his ailing mother who is suffering from cancer.
"Since the mother of the life convict is in a serious condition and she has to undergo surgery on November 30 and taking into account of the situation, the emergency leave has to be granted.." Justice K.K. Sasidharan said while concurring with the submissions of Advocate Vijayendran appearing on behalf of the convict I Magesh.
Magesh was found guilty of murder by the sessions court and sentenced to life. His wife had represented to the authorities seeking at least 30 days leave for her husband so that he could be with his mother when she undergoes operation.
The plea, however, was rejected on the ground that he had already exhausted the 15-day leave available to him for the year.
Concurring with the arguments of the counsel for the convict that jail authorities were empowered to grant emergency leave to life convicts in case of serious illness of their close relatives, the judge directed the authorities to grant him leave for five days from 9 am on November 30.
He should report back to jail by 5pm on December 4, the judge said, adding the jail superintendent was at liberty to impose reasonable conditions to ensure the safe return of the convict to jail.
