A division bench, comprising Justices S Nagamuthu and V S Ravi, asked the question to the counsel for CBI when he said they have enough evidence against the accused.
The amended Information Technology Act says that even video and photo evidences could not be taken at face value unless they were supported by experts' certificate that they were genuine, the Judges said and asked CBI to submit the evidence along with certification by experts.
Three employees of the daily were killed in the attack on May 9, 2007, following the publication of a survey which gave an edge to then Deputy Chief Minister and Karunanidhi's son M K Stalin over his brother Union Minister M K Alagiri to succeed their father.

The district court had acquitted all the accused on December 9, 2009, saying the prosecution failed to prove the case beyond all reasonable doubt.
CBI filed a plea in the High Court in July, 2010 against the acquittal and pleaded to condone the delay in preferring an appeal.
In March 2014, Poongodi, mother of one of the three employees who died in the attack, also filed a revision petition in the High Court challenging the acquittal and urged the court to condone the delay of 1,434 days in filing the petition.
In April 2014, the court ordered notice to the accused through newspaper publication and condoned the delay.
